In my view the 9th circuit court of appeals got it right. The work appears to take two properties the author does not own and created an unauthorized derivative work of both. In doing so it’s creating a product that usurps the market for both properties, doesn’t appear to be particularly transformative (inventive sure, imaginative sure, but transformative? The pictures are near carbon copies of the dr Seuss books other than the derivative works of Star Trek) and it’s obviously commercial…

Anyone who creates original content should want property protected. Not just to protect the property itself, but so there’s a level playing field between small creators. If bob creates a new IP and has to compete with Jane is unlawfully piggybacking on a billion dollar IP, then it’s clear that bob is going to have to work way harder than Jane to reach the same level of success. Meanwhile, Tim who is a creator of middling success may face sufficient usurption of the market for his work that instead of being able to sustain himself from his work he needs to keep working a day job because of all the copycats using his property.

I’m amenable to the idea that there needs to be more limited restrictions on intellectual property than exist such as having it lapse within a creators lifetime, but I’m not for throwing the baby out with the bath water.

Frankly, the whole "use your name and face" thing is bullshit and the people who advocate for it online need to an hero themselves. The Internet isn't a nice place. It has the best people but it also has the worst. People who want to hurt you for no reason. People who think it's fair game to kill you because you disagreed with them. For those people, you should absolutely stay anonymous! Pseudonyms are a good thing, it lets people say what they want without fear of being unfairly attacked outside the marketplace of ideas by people who can't win otherwise.

For those using their real names, more power to you, we all have different thresholds of tolerance and our lives are structured differently so some people are better suited to putting their face next to controversial opinions than others.

I can 100% guarantee that the Korean family running the Chinese food restaurant didn't build their shop thinking that 95% of customers should be excluded, and I'm certain that if some white idiot came in and started trying to chase off all their non-Chinese customers the cops would be called pretty quickly. The point of opening the restaurant was to make money from anyone who wants Chinese food.

It's a philosophy that can only lead to the opposite of what anyone who wants progress would want -- a ghettoization of culture and an isolation of different people from different things just because someone with a different skin color discovered or invented it.

@grumbulon Chinese Restaurants are appropriation. They don't sell Chinese food there, they sell Chinese-American food where the Chinese immigrants took American cooking techniques and foods and created a new cooking style.

@boilingsteam One of my peeves with windows at the moment. And their new stuff isn't any better -- You still can't consistently set an IP address from the settings app. It's been 6 years, heads should be rolling.
