It's also very serious and a real threat because if Governor Nuisance has any sustained success in suing Trump for the latter's invocation of 10 U.S. Code § 12406 about the National Guard in this sort of situation, he can invoke the Insurrection Act. Which then allows the Marines sent to LA to do the front line work the National Guard is doing now.
The former law was passed in 1994 when the Congress and President were Democrats, I'm guessing to give a president something less than the Insurrection Act which G. H. W. Bush used for the 1992 Rodney King verdict LA riots.
